TERMS OF SERVICE

Welcome to www.poshskins.com. MOXIE SKINS LTD (Company number 16553071, registered office: Academy House, 11 Dunraven Place, Bridgend CF31 1JF, United Kingdom) and/or its affiliates (referred to as we, our or "PoshSkins") provide website features and other services to you when you visit or shop at www.poshskins.com ("the Site"), use our products or services, or use software provided by us in connection with any of the foregoing (collectively the "Services"). PoshSkins provides the Services to you subject to the conditions set out in this document.

Please read the following terms and conditions carefully before using the services!
This document constitutes a legally binding agreement between you as a user of the Site (hereinafter defined as you, your, or User, as the case may be) and PoshSkins.

1. APPLICABILITY AND ACCEPTANCE OF THE REGULATIONS

• 1.1 The use of the Services and/or access to the Site are subject to the terms and conditions contained herein, including the Payment Policy, the Refund Policy, the Cancellation Policy, the Privacy Policy, the Cookie Policy, the Anti-Money Laundering Policy, the Catalogue Policy, the GDPR Compliance statement and all other terms and conditions in relation to the use and/or operation of the Site that may be published from time to time by PoshSkins. This document and all other terms and conditions of the Site are hereinafter generally referred to as the "Regulations". By using the Site or Services you signify your agreement to be bound by these Regulations. You are requested not to use the Site or any Service if you do not accept the Regulations.
• 1.2 Users must not use Services and accept the Regulations if they (a) are not of the age to sign a valid agreement with PoshSkins or (b) are not permitted to use the Services in accordance with the laws of the United Kingdom ("UK") or any other country/region, including the country/region of the User's residence and where the Services are used. Our services are not available to residents of, or users located in, Russia, Belarus, Iran, North Korea, Syria or Cuba.
• 1.3 We may update this document. The "Last updated" date at the top shows the current version. We announce a material change on this site, and by email if you have given us an address, at least 30 days before it takes effect. Orders and top-ups made before a change keep the terms that applied when you made them.
• 1.4 The Regulations shall be written in the English language. In the event that the Regulations is translated into any other language and there is any inconsistency between the version in the English language and such translation, the English version shall be the binding version.
• 1.5 PoshSkins does not offer separate service agreements: these Regulations and the policies named in 1.1 are the only terms that apply to your use of the Site.
• 1.6 These Regulations are changed only in the way described in 1.3.
• 1.7 When you use any Services or send emails to us, you are communicating with us electronically. We will communicate with you by email or by posting notices on the Website or through other Services. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notice, disclosures and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing, unless mandatory applicable laws specifically require a different form of communication.
• 1.8 Accounts are for individuals using the Services for their own personal purposes. You may not open or use an account on behalf of a company or other organisation, or to buy items for resale or for a business.

2. ITEM DELIVERY, DELIVERY ESTIMATES & STEAM TRADE PROTECTION

• 2.1 Items are delivered to the Steam account linked to the trade URL you provide. How long delivery takes depends on the seller who supplies your item; there is no fixed maximum. Until your item has reached your Steam inventory, you can cancel the order at any time for a full refund (see 2.5).
• 2.2 PoshSkins sells you the item (see Section 6). To fill your order, we buy the item from a third-party seller, and that seller sends it to your trade URL as a Steam trade offer. The delivery estimate shown on an item page is an estimate, not a guarantee. It is derived from how quickly that particular supplying seller has historically completed transfers, and for some sellers it is several days or longer. It is not a commitment by PoshSkins, and the actual time depends on when that seller sends the trade and on Valve's systems.
• 2.3 Valve applies Steam Trade Protection to CS2 items, placing a cooldown of up to 7 days on an item after it is traded before it can be traded onward. Where the item we source for you is subject to such a cooldown, it cannot be sent to you until that cooldown expires. This is a Valve restriction that applies to every trading site and cannot be removed, waived or expedited by PoshSkins.
• 2.4 After delivery, the item is subject to the same 7-day Steam Trade Protection hold on your account before you can re-trade or sell it. PoshSkins is not responsible for delays caused by Steam/Valve, by the supplying seller, by an incorrect or expired trade URL, by a private or full Steam inventory, or by trade restrictions on your Steam account.
• 2.5 If your item is not delivered, you are entitled to a refund. Where an order cannot be fulfilled - including where the supplying seller fails to complete the transfer - we will either source the item from an alternative seller or refund you in full. You can cancel an order at any time until you have accepted the Steam trade offer and the item is in your Steam inventory. A trade offer that has been sent but not yet accepted does not end this: you can still cancel. Write to support@poshskins.com with your order number and you are refunded in full; see our Refund Policy for how refunds are paid. Nothing in these Regulations limits your statutory rights as a consumer.

3. SERVICE FEES

• 3.1 PoshSkins charges a flat 10% service fee, already included in the displayed price. Nothing is added to the displayed price at checkout. This covers platform operations, secure transactions, customer support, and fraud protection. The full total is itemized and shown before you confirm payment.
• 3.2 Any changes to our pricing structure will be communicated with 30 days' notice to Users by posting such amendments on the Site. Promotional pricing may be offered at our discretion, with clear terms communicated during the promotional period.
• 3.3 Prices and fees are shown in US dollars unless you pick another display currency. You pay only in US dollars or euros: a wallet top-up is charged in euros when EUR is your selected currency and in US dollars otherwise; a card payment at checkout is charged in US dollars. Other currencies are for display only. A single wallet top-up is from €1 to €20,000, or its equivalent in the currency you pick at our reference exchange rate (see our Fees page, Section 8). If your card is in another currency, your bank may convert it. The details are in our Payment Policy.
• 3.4 The user has to sign in to access and use the Site. PoshSkins reserves its right to restrict access to or suspend the provision of Services (including but not limited to any functions and/or feature of the Site) without prior notice to you in advance.
• 3.5 Services (or any other functionalities incorporated into the Site) can be different for different countries or regions. No guarantee is given to the effect that a Service or functionality of a certain type or reach will be available for all Users. PoshSkins can, at its absolute discretion, restrict, decline or create another level of access relating to the use of Services (or any other functionality incorporated into the Site) for different Users.
• 3.6 Our pricing structure is itemized at checkout, as described in Section 3.1 above and on our Fees page. The service fee is a single flat percentage applied to every item.
• 3.7 Unused wallet credit from a top-up is refundable within 14 days of the top-up, as set out in our Refund Policy.

4. GENERAL TERMS AND CONDITIONS OF USE

• 4.1 Subject to your compliance with the Regulations and your payment of any applicable fees, PoshSkins or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable licence to access and make personal and non-commercial use of the Services.
• 4.2 All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by PoshSkins or its licensors, suppliers, publishers, rights holders, or other content providers.
• 4.3 You may not misuse the PoshSkins Services. You may use the PoshSkins Services only as permitted by law. The licenses granted by PoshSkins terminate if you do not comply with the Regulations or laws.
• 4.4 The User agrees to use the Sites and Services for personal purposes only. The User must not (a) duplicate, copy, download, disseminate, sell, distribute or resell any Services, information, texts, graphics, video clips, sounds, screenplays, files, databases, or lists whatsoever available on or via the Sites (Site Content) and (b) duplicate, copy, download, compile or otherwise use for commercial purposes any Site Content that is competitive to PoshSkins or use the Site Content in any other commercial way. It is forbidden to retrieve the Site Content systematically to create or compile, either directly or indirectly, a collection, compilation, database and catalog (by using robots, search engines, automatic or manual devices) without written permission from PoshSkins. The use of any content or materials from the Sites for purposes not specified in the regulations is forbidden.
• 4.5 The User is obliged to become familiar with the PoshSkins Privacy Policy specifying all the details of how to protect and use Users' personal information that is in possession of PoshSkins and our partners. By using the Site or Services you signify your agreement to follow and be bound by the terms of the Privacy Policy.
• 4.6 The Site links to other websites, such as Steam. Read their terms and privacy policies before you use them. PoshSkins has no control over websites run by others, does not monitor them and is not liable to Users for those websites, their content or the products or services available on them.
• 4.7 The User agrees that he/she will not take any action to compromise the integrity of computer systems or networks belonging to PoshSkins and/or any other User or to obtain unauthorised access to such computer systems or networks.
• 4.8 You can cancel an order as set out in 2.5. The price stated in the order is a guaranteed price. We will not ask you for any more payments after the purchase. When the transaction is complete, you will receive the skin in your Steam inventory.
• 4.9 Using automation scripts and programs, which cause server performance issues, will be considered a violation of rules and it may result in a penalty for the account.
• 4.10 If a purchased CS2 skin has not been delivered, you can cancel the order for a full refund at any time until it reaches your Steam inventory, as set out in 2.5 and in our Refund Policy.
• 4.11 You can pay for CS2 skins on the Site from your PoshSkins Wallet balance, by Visa or Mastercard card, or with both (the wallet covers part of the price and the card the rest). PoshSkins may set or change limits on the amount of Wallet balance that can be used per transaction. Your wallet balance is for buying items on the Site; paying a balance out to a card or bank account (a cash-out) is not offered.
• 4.12 We use Steam Web API Services in order to provide functionality such as loading CS2 skin data and images. By using this functionality you agree to be bound by Steam's Subscriber Agreement.
• 4.13 We are entitled to cancel any order made by the buyer which remains unpaid for 48 hours.

5. USERS ACCOUNTS

• 5.1 The User has to subscribe/register his/her self to/with the Site to obtain access to and use certain Services. Any User who has completed the subscription/registration may hereinafter also be referred to as "Member". Unless otherwise permitted by PoshSkins, one User should subscribe for and hold one User Account only. PoshSkins can close or suspend a User Account if PoshSkins reasonably suspects that the User has subscribed to or controls two or more user accounts. PoshSkins may reject a User registration application without specifying reasons.
• 5.2 You sign in with your Steam account. PoshSkins opens an account linked to your Steam ID; we do not issue a separate password and never see your Steam password.
• 5.3 Each User is personally responsible for keeping their Steam account secure and for all actions taken as part of their PoshSkins account. No User may share, assign or authorise the use of their account by any other person. The User undertakes to tell PoshSkins immediately of any unauthorised use of their account or any other breach of security in their account.
• 5.4 Everything done through your account (for example orders, wallet top-ups, purchase confirmations and messages to support) is treated as done by you.
• 5.5 The User acknowledges that sharing their account with other people or giving access thereto for many people other than the User's personnel may cause irreversible damage to PoshSkins or other Site Users. The User is obliged to protect PoshSkins, our partners, officers, personnel, agents and representatives against losses and damage (including non-financial) caused by the use of their account by multiple Users. The User also agrees that if their account is shared by multiple persons or it is impossible to keep it safe, PoshSkins will not be held liable for any loss or damage caused by compromising safety and is entitled to suspend or close such a User account without being liable to the User.
• 5.6 You must give us the information an order needs: a Steam trade URL for delivery, an email address for your order confirmation (required at checkout; if you turn on Purchase security, the same address receives your purchase codes, see 8.4), and a billing address when you pay by card. All information provided by you shall be true, accurate, current and complete.
• 5.7 Once provided, your display name cannot be changed except in limited cases handled by the Customer Support Department.

6. WHO YOU ARE BUYING FROM

• 6.1 PoshSkins is a direct resale storefront, not a peer-to-peer (customer-to-customer) trading platform. You buy every CS2 skin on the Site from PoshSkins. To fill your order, we buy the item from a third-party seller, and that seller sends it to your Steam account as a trade offer (see 2.2). Users cannot list, price or sell their own Steam inventory on the Site.
• 6.2 Because PoshSkins sells you the item, PoshSkins - not the third-party seller who sends the trade offer - is responsible to you for accurate item descriptions, order fulfilment and the Buyer Protection commitments in Section 12.
• 6.3 When you buy, you agree to: pay only with a card or wallet balance that is yours; give a trade URL for a Steam account you control and keep it up to date; buy for yourself, not for resale or on behalf of someone else; not use orders or wallet top-ups to move money for anyone else, or buy for or on behalf of sanctioned individuals or entities. All CS2 skins offered on the Site are, to the best of PoshSkins' knowledge, legitimate items obtained through official Steam channels or PoshSkins' inventory-sourcing partners.
• 6.4 PoshSkins shall not be held responsible for any third-party services PoshSkins relies on to source inventory (including its skin-supply partners or Steam) being changed, suspended, or terminated, to the extent this is outside PoshSkins' reasonable control.

7. FORBIDDEN ACTIONS

• 7.1 There is nowhere on the Site for Users to publish content. PoshSkins may refuse or remove any information you give us (for example a trade URL or a message to support) that is unlawful, breaches the Regulations or would make PoshSkins or our partners liable.
• 7.2 If the User violates any provision of the Regulations or if PoshSkins reasonably believes that it has been violated by any User, PoshSkins is entitled to impose a penalty on such User or suspend or delete the account or discontinue the use of any Service whatsoever by such User without being liable therefor to the User. PoshSkins is also entitled to restrict, refuse or ban the existing or future access to the Services provided by PoshSkins. The penalties PoshSkins can impose are a warning, restricting any functionality of the Services for the period PoshSkins finds appropriate, and suspending or closing the account. PoshSkins reserves the right to repossess the User's property (i.e. CS2 skins, account balance) in case of gross violation of any provision of the Regulations.
• 7.3 Notwithstanding the generality of the foregoing, the User will be deemed to be guilty of a gross violation of the Regulations in the following events:
• a) as a result of a complaint or notice filed by a third party, PoshSkins can reasonably believe that the User has failed, either deliberately or substantially, to perform their obligations under a contract with such a third party,
• b) PoshSkins can reasonably suspect that the User has used a stolen credit card or any other false information when contracting with a partner,
• c) PoshSkins can reasonably suspect that any information provided by the User is invalid, incomplete, untrue, inappropriate or misleading,
• d) PoshSkins suspects that actions taken by the User expose PoshSkins, its partners and any other Users to financial losses or may result in making the same liable.
• 7.4 PoshSkins will cooperate with the police and other authorities, and with people harmed by fraud, in criminal or civil investigations. PoshSkins may disclose a User's identity and contact details when the law requires it, when a law enforcement body asks for them, or under a court order.
• 7.5 If a breach of the Regulations involves fraud or other unlawful conduct, PoshSkins may tell the payment provider and the skin-supply partners that handle your orders. They may restrict or end your use of their services under their own terms.
• 7.6 Each User agrees to indemnify and hold harmless PoshSkins, our partners, officers, personnel, agents and representatives from and against any losses, damage, claims or liabilities (including legal costs incurred to claim full compensation) that may result from the use of the Sites or Services or from the violation of Regulations.
• 7.7 To the fullest extent permitted by law, PoshSkins is not liable to you or anyone else for item data, images or other material on the Sites that comes from third parties (such as Steam or our inventory-sourcing partners). PoshSkins reserves the right to assume, at our expense, full control and defence of any case other than indemnity for a member. In such an event the Member will cooperate with PoshSkins in claiming any defence.
• 7.8 Once an item is in your Steam inventory, we do not take it back or refund it because you changed your mind (see our Refund Policy, Section 4). This does not affect a refund for an item that is not as described, counterfeit or fraudulent (Section 12).

8. HOW A PURCHASE WORKS

• 8.1 When you buy a CS2 skin on the Site, you are buying it directly from PoshSkins, not from another User. PoshSkins makes reasonable efforts to describe each item accurately, but does not guarantee that every attribute shown (sourced in part from third-party inventory APIs) will be defect-free at all times, and is not liable for the acts of the underlying inventory-sourcing partners to the extent outside PoshSkins' reasonable control.
• 8.2 You are personally responsible for observing all the terms and conditions of your transactions on the Site, including but not limited to payment terms, returns, delivery, and fees.
• 8.3 You agree to provide all necessary information and documents that may be required by PoshSkins in connection with your transactions (for example, a valid Steam trade URL). PoshSkins is entitled to suspend or remove your account if you fail to provide required information in a timely manner.
• 8.4 Purchase security (optional): in Settings → Purchase security, or when checkout offers it, you can turn on Purchase security: add an email address and confirm it with a 6-digit code we send there. From then on every purchase, from your wallet or by card, waits for a fresh 6-digit code we email you; each code works once and for 10 minutes. Wallet top-ups do not need a code. Turning Purchase security off, or changing the email, needs a code sent to the current address. Sign-in itself always goes through Steam.

9. LIMITATION OF LIABILITY

• 9.1 To the fullest extent permitted by law, all Services provided by PoshSkins on or via the Sites are made available on an AS IS, IF AVAILABLE, and WITH ALL DEFECTS basis, and PoshSkins hereby expressly declines all warranties, including but not limited to any warranty of condition, quality, durability, functioning, reliability, merchantability or suitability for any specific purpose. All warranties, representations, conditions or undertakings are hereby excluded.
• 9.2 To the fullest extent permitted by law, PoshSkins does not make any representation or give any warranty in relation to the validity, accuracy, correctness, reliability, quality, stability, completeness or commonness of any information provided on or via the Sites. PoshSkins does not represent or warrant that the manufacturing, import, export, distribution, offering, presentation, purchase, sale and/or use of any CS2 skins or services offered on the Sites is free from infringement of any third party rights, nor does PoshSkins make any representation or give any warranty in relation to any of the Services offered or presented on the Sites in any aspect.
• 9.3 Each User shall be personally responsible for his/her act of downloading or otherwise obtaining any material from and/or via the Website, and the User will be held liable for all loss and/or damages that may be caused to PoshSkins as a result of and/or incidental to any downloaded material. No information or advice, provided either orally or in writing, that can be obtained by the User from PoshSkins or from/via the Site should not be deemed to be any warranty or representation of whatsoever nature.
• 9.4 The Sites can give the User access to services or CS2 skins provided by independent third parties. No warranty or representation is given in relation to such services or CS2 skins in any aspect. In no event can PoshSkins or our partners be held liable for such services or CS2 skins.
• 9.5 Each User agrees to indemnify and hold harmless PoshSkins, our partners, management, officers, and personnel from and against any losses, damage or claims (including legal costs incurred therefrom) that may occur as a result of any use of the Sites or Services by the User or violation of any of the terms and conditions of the Regulations.
• 9.6 PoshSkins cannot be held liable for any specific, direct, indirect, punitive, incidental or consequential damage or any other damage (including but not limited to loss of profit or savings, business disruptions and loss of information) as a result of:
• a) using or being unable to use any of the Sites or the Services;
• b) damaging CS2 skins, samples, data, information or services purchased or obtained from the User or any third party via any of the Sites;
• c) infringing any third party rights or claims and/or receiving any demands in relation to the manufacturing, import, export, distribution, offering, presentation, purchase, sale and/or use of CS2 skins or services offered on the Sites and the fact that they may infringe or be deemed to infringe any third party rights;
• d) any data or private information being accessed by any third party in an unauthorised manner;
• e) any statement or conduct on the Sites; or
• f) any other matter relating to the Sites that may amount to negligence.
• 9.7 Notwithstanding the foregoing, the total liability of PoshSkins, our personnel, agents, partners, representatives and all persons acting on our behalf for all claims arising from the use of our Sites or Services throughout the entire calendar year is limited in respect of each User to (a) the total fees paid by Users to PoshSkins or our partners within a calendar year or (b) £1,000, whichever is lower. The foregoing sentence does not waive the need to prove the respective damage alleged to be sustained by the User. Time limits for reporting a problem with an order are set out in Section 12.3.
• 9.8 The limitations and exclusions of liability under the Regulations refer to the fullest extent permitted by law and will be effective regardless of giving notice to PoshSkins that such damage may occur.

10. FORCE MAJEURE

• 10.1 In no event can PoshSkins be held responsible for any delay, interruption or error of the content or service provided via the Sites if caused, either directly or indirectly, by forces of nature, agents beyond our reasonable control, including failures of the Internet, computer hardware, telecommunications or any other equipment, blackouts, strikes, labour actions, riots, insurrections, civil commotion, labour or material shortages, fire, flood, storms, explosions, acts of God, war, government acts, court or tribunal orders or third party negligence.

11. INTELLECTUAL PROPERTY RIGHTS

• 11.1 PoshSkins is the sole owner and legal licensor of all the rights and interests to the Sites and their Content. The Sites and their Content contain business secrets and other intellectual property protected by international copyright and other laws. All the titles, ownership and intellectual property rights to the Sites and their Content remain with PoshSkins and our partners. All rights to any claim under the Regulations or raised by PoshSkins are reserved in this case.
• 11.2 PoshSkins and related icons and logos are registered trademarks or trademarks of MOXIE SKINS LTD and PoshSkins's related icons and logos are registered trademarks or trademarks and service marks of MOXIE SKINS LTD in various jurisdictions and are protected by the relevant copyrights, trademark or other intellectual property rights. Unauthorised copying, modification, use and publication of such trademarks is prohibited.
• 11.3 PoshSkins may cooperate with independent third parties involved in the provision of Services (e.g. service provider confirmation and verification). It is forbidden to use any trademark, service mark or logo belonging to any third party without prior permission from such a party.

12. BUYER PROTECTION

• 12.1 Because PoshSkins sells you every item (see Section 6), PoshSkins Buyer Protection is a commitment PoshSkins makes directly to you: (a) not delivered - you can cancel the order at any time until the item reaches your Steam inventory and are refunded in full (see 2.5); (b) not as described, counterfeit or fraudulent - if your report is upheld, you are refunded in full. PoshSkins decides each report under (b) after looking at the evidence, and you can ask for a second review as described in our Refund Policy, Section 7. Refunds are paid as described in our Refund Policy, Section 6.
• 12.2 We reserve the right to correct any obvious errors we encounter in processing a refund, by adjusting the amount charged or credited to the payment method or Wallet balance used in the original transaction.
• 12.3 Time limits: there is none for cancelling an order that has not been delivered (see 2.5). Report that a delivered item is not as described, counterfeit or fraudulent within 30 days of the order, the same period as in our Refund Policy. Nothing here limits your statutory rights as a consumer.

13. NOTICES

• 13.1 All legal notices or requests addressed to PoshSkins should be sent in writing to PoshSkins personally, by door-to-door service or by post to the following address: MOXIE SKINS LTD, Academy House, 11 Dunraven Place, Bridgend CF31 1JF, United Kingdom, or by email to support@poshskins.com. Notices will be accepted once they have been received by PoshSkins in one of the forms indicated above.
• 13.2 All legal notices or requests addressed to Users will be effective if sent by email to the last email address the User gave PoshSkins, or if placed in a publicly available place on the Site free of charge. The notice is deemed to have been served on the User if PoshSkins is able to:
• a) present such communication in the physical or electronic form in which it has been sent to the User; or
• b) immediately publish such a notice in a publicly available place on the Site free of charge.
• 13.3 The User agrees that all arrangements, notices, requests, disclosures and any other communications to be sent by PoshSkins electronically will meet the legal requirements for serving such communications in writing.

14. GENERAL PROVISIONS

• 14.1 The Regulations constitute the entire agreement between you and PoshSkins in respect of your use of the Sites and Services and supersede all previous agreements, either oral or in writing, regarding the same subject.
• 14.2 PoshSkins and the User are independent contractors and no agency, partnership, joint venture, employment or franchise between them are stipulated in the Regulations.
• 14.3 If any provision of the Regulations turns out to be invalid or unenforceable, such a provision should be deleted and the remaining provisions will continue to be valid and enforceable.
• 14.4 Headings are used for reference only and in no way do they define, restrict or describe the scope or size of any section.
• 14.5 The unenforceability of any right PoshSkins may have or its waiver of any violation against the provisions of the Regulations do not constitute a waiver of the claim to enforce such a right or a waiver by PoshSkins of its right to claim such enforcement in respect of subsequent or similar violations.
• 14.6 PoshSkins is entitled to lay down the provisions of the Regulations (including all our rights, titles, benefits, interests, duties and obligations in the Regulations) in respect of every person or entity (including PoshSkins partners).
• 14.7 The Regulations are governed by the laws of England and Wales without reference to their conflicting provisions, and disputes are heard by the courts of England and Wales. Nothing in this clause takes away the protection you have as a consumer under the mandatory law of the country where you live, or your right to bring proceedings there.
